Toledo police say it was a teen who shot and killed Vicktron Moore, 30, and injured his passenger, Terrance Cohen.
Damar Smith, 17, faced a judge Monday. Juvenile prosecutor Lori Olender asked the judge to keep Smith locked up because of the violent nature of the crime.
Police say Moore and Cohen were shot in a car. Moore was allegedly talking to Smith when the teen started shooting. The coroner says Moore was shot in the head at close range. Cohen was shot in the shoulder.
The teen suspect will be tried as an adult
"At this point we're looking at his age being 17 and the fact that it's a murder. It would be considered what we call a mandatory certification or transfer to the adult division, where we would have to know proceed with a probable cause hearing, and the state fully intends by the end of this week to have a motion filed," said Juvenile Prosecutor Lori Orlender.
The victim's family is glad police made an arrest.
"If you do the crime, you do the time. I don't feel sorry for the guy," said Roderick Wright.
Prosecutors say Smith is no stranger to the court system. He's had several misdemeanors for traffic offences and delinquency. But no charges for any violent crimes until now.
"Gun cases right now have been just unbelievable and he will be 18 in August. This is such that two people were shot one was killed. The state definitely doesn't think that the three years and a couple of months that would be left here would be sufficient for such a crime," said Orlender.
