Local attorney pulled from case

A local attorney won't be representing a couple accused neglecting their adopted handicapped daughter. A judged has barred attorney Ann Baronas.

According to court documents the judge found a serious potential conflict of interest in this case and here's why.

According to documents a judge has prohibited attorney Ann Baronas from representing Lee Ann Henry and her husband. They're charged with child endangering. They're accused of neglecting their adopted 17 year old daughter who is handicapped.

The court papers state Ann Baronas was once appointed the guardian to handle legal matters of a potential witness in this case. The judge views it as a conflict of interest.

According to the court documents the court is concerned if Baronas is allowed to question the potential witness the youth may "tailor her testimony to what she perceives attorney Baronas would want"

The court also fears the young witness may not "understand why her former protector would now be asking questions from a confrontational posture"

Mrs. Henry argued the court should honor her choice of attorney.  The judge said he took the Henry's argument into consideration, but believes there's sufficient evidence of serious potential conflict to remove Baronas from the case.

13abc call Attorney Baronas to get a comment, but she was not in the office
