Judge: Mich. militia head, son held long enough

DETROIT (AP) - A judge says the two years a southern Michigan militia leader spent in jail awaiting trial is enough punishment for possessing illegal weapons.

Federal prosecutors in Detroit asked Wednesday for additional months behind bars for David Stone. But Judge Victoria Roberts says it "would not make much sense."

Stone pleaded guilty in March after Roberts dismissed more serious charges against him and members of the Hutaree militia. Authorities described it as a violent, anti-government group poised to rebel against law enforcement. But the judge last spring found no evidence of a specific plan for an uprising.

The 48-year-old Stone spent two years in jail, from the time of arrest through his acquittal at trial. His son, Joshua Stone, was also sentenced to time served for a gun crime.
