Ottawa Hills settles with man shot by police

OTTAWA HILLS, Ohio -

$5 million is how much the village of Ottawa Hills will have to shell out after one of its officers shot and paralyzed a man in 2009.

It all started with what was supposed to be a routine traffic stop and from May 23rd of 2009, Mike McCloskey's life has been anything but routine.

The 14 page settlement reads, "without any admission of liability, the parties have agreed to settle this case for the amount of $5,000,000."

McCloskey was pulled over on his motorcycle on a routine traffic stop.  After a movement by McCloskey, officer Thomas White opened fire.  McCloskey survived but is paralyzed from the waist down.  Officer White was convicted of felonious assault.  An appeal of that conviction is in the hands of the court of appeals.

McCloskey sued the village of Ottawa Hills "for alleged constitutional and state law violations related to the encounter."

Instead of going to trial both sides settled on the $5 million mark and this is expected to be the end.

The settlement reads "plaintiff hereby completely releases and forever discharges the defendants from any and all past, present or future claims."

When 13abc asked why the settlement and why at that price, the Ottawa Hills village administrator offered us a "no comment."   McCloskey's attorneys did not return a call for comment.
