Unarmed Ohio man shot by police files suit

Posted: Updated:

CINCINNATI (AP) - An unarmed man who says he had his hands in the air when a Cleveland police officer shot him in the chest over a traffic violation last year has filed a federal civil rights lawsuit in the matter

Greg Love of Maple Heights and two others involved in the June 23 shooting filed the action in federal court on Feb. 13.

The 29-year-old Love says Officer Vincent Montague Jr.'s actions were "extreme and outrageous" and that department leaders have fostered an atmosphere ripe for constitutional violations.

Montague returned to full duty this month.

A police document shows Montague was suspended for three days for putting himself in "a position of imminent danger" by reaching into Love's vehicle during the traffic stop.

Police and city spokeswoman declined to comment on the lawsuit's allegations. Montague's listed phone number does not accept messages.
