Restraining order granted in doggie death row case

Nala and Bugger are safe, for now. Their fate is in the court's hands. The Sylvania Township dogs were set to be euthanized Friday, but their owners filed a motion to delay them from being put down and were granted a temporary restraining order until Tuesday.

13abc was with Janni Juhasz when her attorney called about filing court papers to save the dogs, who were convicted of killing two show hogs.

"That is going to put us in a position where the dogs will not be killed over the weekend. I think what is going to happen is that stay of execution we are filing an extension to get the appeal in and then they are going to file the appeal ASAP," Juhasz.  

Juhasz will pursue a second appeal. Last month, judge ruled in favor of Bedford Township's law requiring the dogs be euthanized. The dogs' owners have consulted with a forensic expert from Florida. They say he's looked at the photos presented as evidence in this case.

In a statement to the family he says, "There are no specific recognizable bite marks that might be attributable to the dogs." 

The dogs have been locked up more than 10 months.  

"Are you concerned how your dogs will react to you when if they come out of this situation?," asked 13abc's Alexis Means. "How they're going to react to us? No, I think they're going to exactly who we are they're going to be elated," says Juhasz.  

Juhasz says she feels pretty good about what lies ahead.

"This time we're going to be to be out of Monroe Co and I really feel like that is going a give us an unbiased opinion," she says.
   
On Tuesday a hearing will be held to extend the restraining order until there's a final decision in the appeal.

    Toledo police have arrested a man in connection with an attempted kidnapping at an East Toledo hotel Monday. Investigators charged Jaequan Smith with kidnapping and burglary. He was arrested early Tuesday morning. He’s charged with trying to kidnap a 4 and a half month old baby from his mom’s hotel room. It happened around 6:00am Monday at the Days Inn on Miami Street. The mom told police she was walking her boyfriend out of the hotel and left the infant in the room.
