Who maintains property when homeowner dies?

TOLEDO, Ohio - The tall grass and weed issues are back.  But what happens when the neighbor with the issue is dead?   That has the 13abc I-Team asking questions and getting answers.

In this instance, it’s not a piece of public property where you can go down to City Hall or knock on the neighbor's door to ask them to clean it up.   There is no home on this property.  The homeowner died several years ago and now neighbors are left with a mess next door.

It looks like a cross between an overgrown garden and a forest that's about to get out of hand.  A few years ago a home stood there in the 1200 block of East Broadway in East Toledo.  Marc Titta lives next door.

“I have already had three mice I have caught in my house, 4 cats in my yard.  I wanna say I had a baby possum and stuff like that already," said Titta.

He believes the critters originated from this lot next door, overgrown with weeds, trees and garbage.

"I've stepped on nail, trying to mow it.  And boards with splinters coming out about that big," said Titta. 

It's an eyesore that Titta says comes with some other unintended consequences.  Like people walking through the weeds.  Some of them are even covering the power and phone lines.

The I-Team checked into the property.  The owner died several years ago and as of last year there was no probate filed on the property.  Taxes are owed but it's not in foreclosure.

No next of kin of the homeowner has stepped up yet, so it's basically in limbo leaving neighbors anxious.

"I don't want to move because of my kids' safety," said Titta.    

The I-Team reached out to the city of Toledo to see if they'll be able to help.  The last complaint they say they've received was last year.  They noted this most recent complaint Thursday and say this property is on their radar.
