Stainbrook to sue Husted over BOE recommendations

Tuesday's letter from secretary of state Jon Husted will unleash a likely court challenge.

In the letter, he rejected Ben Roberts and Kelly Bensman as the two new Republicans to sit on the Lucas County Board of Elections.

The party insists Roberts and Bensman are qualified and William Todd, the attorney for the party, told us today he is reviewing Husted's reasons for rejecting the pair and will likely ask the Ohio Supreme Court to overturn the Husted decision.

The party would then ask the court to make a quick decision, in the matter, given a special election in Lucas County is set for August 5th.

However, any ruling could linger into mid-July and then there is no guarantee that the court will overturn the secretary of state.

That could mean two more candidates would have to be chosen which could take even more time.

There is a second faction of the Lucas County Republican Party that wants to submit recommendations to Jon Husted.

But the chairman of the Ohio Republican Party told 13abc's Bill Hormann, David Kissinger's faction is *not recognized* as the new party.

So right now, it appears any dispute over seating members on the board of election will be between Stainbrook's official party and Jon Husted.
