A construction worker with Gerken Paving has been killed in an accident on US 24. That’s according to the Ohio State Highway Patrol.

Officials have identified the victim as 42-year-old Nathan Soto from Napoleon.

The accident happened on US 24 eastbound at milepost 65.5 in Waterville Township according to State Troopers. Officials say 34-year-old Michael Massucci from Waterville was driving in the left lane when he changed lanes and traveled too far over, hitting Soto and the crew's work truck.

"There was a passenger with him," Trooper Brandon Chaney, Ohio State Highway Patrol, said. "I believe [the passenger] was handing the cones to the person who was struck."

Witnesses tell troopers they don't believe Massucci was speeding.. Troopers say they aren't sure why he veered into the construction zone.

"It's been under construction for about a week or two," Tpr. Chaney said. "The zone has been set up warning drivers that there is construction in the area."

He also adds that the tragic accident is a sobering reminder of how important it is to be aware and give crews working or responding to emergencies the space they need on the side of the road.

"That's why we have the law in place to move over or slow down for any stationary vehicles that are on the side of the road with lights flashing," he said.

All lanes of eastbound 24 are now open. The crash is under investigation.
