Lucas Co. sues EPA over Lake Erie water quality

TOLEDO, Ohio (WTVG) - The Board of Lucas County Commissioners says the EPA isn't doing what it's supposed to in order to protect Lake Erie, and now they're suing to force its hand.

The county filed a lawsuit in U.S. District Court in Toledo demanding that the Ohio EPA submit a Total Maximum Daily Load (TMDL) to the federal EPA.

A TMDL would set limits on the amount of phosphorus or other nutrients that are allowed to be in a body of water and still meet water quality standards.

Without a TMDL, Lake Erie couldn't be considered impaired according to the Clean Water Act, and any needed pollution mitigation measures are not mandated by the law.
